Regulation (EU) 2025/40, the Packaging and Packaging Waste Regulation, applies from 12 August 2026 and replaces Directive 94/62/EC. For imported foodservice items the immediate change is that the PFAS limits for food contact packaging bite now, with no stock exhaustion period, and the EU-established importer carries the compliance file. Labelling and format restrictions are dated later, in 2028 and 2030.
Regulation (EU) 2025/40 entered into force on 11 February 2025 and applies from 12 August 2026. It is a regulation, not a directive, so it applies directly in every Member State without national transposition. That is the structural change: under Directive 94/62/EC a buyer in Germany and a buyer in France read different national packaging laws. Under the Packaging and Packaging Waste Regulation they read the same text.
Three things changed on the day for a buyer importing foodservice items from outside the EU.
First, the per- and polyfluorinated alkyl substances limits for food contact packaging took effect. The Commission guidance for the Regulation states that food-contact packaging placed on the market after 12 August 2026 must comply, and that the Regulation “does not foresee a transitional period for the exhaustion of stocks”. Goods already sitting in a Rotterdam warehouse on 11 August 2026 are not grandfathered.
Second, the obligations attach to whoever places the packaging on the EU market. For goods from India, that is the EU-established importer, not the Indian manufacturer. The Commission guidance defines an importer as “any natural or legal person established within the Union that places packaging from a third country on the market”, and adds that a branch without separate legal personality cannot be the importer. Who is named as the responsible economic operator is a contract question your legal team should settle before the first purchase order, and it is covered separately in the analysis of who carries the PPWR obligation on goods from India.
Third, conformity documentation moved from a loose supplier declaration to a defined set. Article 38 sets the conformity assessment procedure, Article 39 requires an EU declaration of conformity, and Annex VII sets the technical documentation. A vendor pack that satisfied a 2024 onboarding may not satisfy a 2026 one.
This is the question that decides whether the Packaging and Packaging Waste Regulation touches your product at all, and the answer is not uniform across a foodservice range.
Article 3(1), point (1) defines packaging by function: items intended to be used by an economic operator for the containment, protection, handling, delivery or presentation of products. The Commission guidance works the point through with a cup. If a supermarket fills a cup with coffee at a refill station, “such cups are packaging, more particularly, ‘service’ packaging”. If “a beverage cup is sold empty in a supermarket to consumers for their private use, it is not considered to be packaging”.
Read that against a leaf plate and two supply models separate cleanly.
| Supply model | Who fills the item | Likely PPWR status | Practical consequence |
|---|---|---|---|
| Caterer buys plates, serves a meal on them to a guest | An economic operator | Service packaging | PPWR requirements and packaging EPR apply to the plate itself |
| Retailer sells a sleeve of plates to a consumer for a home party | Nobody, sold empty | Not packaging on the Commission’s reasoning | PPWR applies to the sleeve, carton and pallet wrap, not the plate |
| Distributor sells plates to both channels | Mixed | Both | The same SKU can be packaging in one lane and not in the other |
The Commission’s worked example is a cup, not a plate. The reasoning transfers, but no guidance text published to date resolves plates by name. Confirm the classification of your own supply model with the competent authority in your Member State before you write it into a specification, because the answer changes who registers for extended producer responsibility, the national schemes that fund packaging waste collection, and that is covered in the guide to who registers for EPR when you import from India.
Note also that the transport and sales packaging around the goods is packaging in every case. The carton, the shrink film, the pallet and the pallet wrap are in scope whatever the plate turns out to be.
Buyers who read a summary in August 2026 often came away thinking every requirement landed at once. It did not. The table below sets out the dates that matter to an imported foodservice line, taken from the Regulation and the Commission guidance document.
| Requirement | Article | Applies from | What it means for an imported leaf plate |
|---|---|---|---|
| PFAS limits in food contact packaging | Article 5(5) | 12 August 2026 | Evidence needed now; no stock exhaustion period |
| Conformity assessment, EU declaration of conformity, technical documentation | Articles 38 and 39, Annex VII | 12 August 2026 | The file must exist before the goods are placed on the market |
| Compostability requirement for named formats | Article 9(1) | 12 February 2028 | Applies to tea and coffee bags, single-serve units and light plastic carrier bags, not to plates |
| Harmonised packaging label | Article 12 | 12 August 2028, or 24 months after the implementing acts enter into force, whichever is later | Artwork changes; implementing acts set the pictograms |
| Restricted packaging formats | Article 25, Annex V | 1 January 2030 | Includes single-use plastic packaging for food and drink consumed on HORECA premises |
HORECA means hotels, restaurants and catering. The Annex V restriction is the one that most changes the competitive position of a plant fibre plate, and it does not arrive until 1 January 2030. Anyone telling you that PPWR banned plastic foodservice packaging in August 2026 has read the wrong article.
Article 5(5) sets the PFAS thresholds for food contact packaging: 25 parts per billion for an individual PFAS, 250 parts per billion for the sum of targeted PFAS, and 50 parts per million for all PFAS combined. The Commission guidance describes a stepwise testing approach, starting with quantification of total fluorine, then confirmation of organic fluorine, then a total oxidisable precursor assay.
For a product with no coating, no lamination and no fluorochemical treatment, the sensible evidence path starts with total fluorine screening rather than a full targeted PFAS panel, because a clean total fluorine result closes the question far more cheaply. The detail of what to ask for, and what a negative result does and does not prove, sits in the analysis of PFAS limits and substances of concern under PPWR.
Annex VII technical documentation also requires, for each plastic part representing 5 percent or more of the total weight of the packaging unit, that the polymer be specified. On a product declared as containing no plastic part, the honest entry is a declaration that no plastic part exists, supported by the composition statement. Ask your supplier for that in writing rather than accepting silence.
Two points cut against a plant fibre line, and a buyer should hear them before the first order.
Recyclability. The Regulation’s recyclability regime is built around established recycling streams. A compostable or organic-recycling route is treated separately from material recycling, and Member State organic waste collection is uneven. A buyer whose sustainability reporting is built on recyclability metrics may find a board product with an established fibre recycling route scores better on paper than a leaf product, even where the leaf product has the lower input footprint. If recyclability scoring drives your tender, say so early and score it honestly.
Documentation depth. A European board converter can put a conformity file in front of you the same week. An Indian manufacturer working to ISO 22000:2018 and ISO 9001:2015, as Foliware India LLP does, will generally need lead time to assemble PFAS screening, composition statements and a declaration set against a named SKU list. Build that into your onboarding schedule instead of discovering it when the container is already booked.
The single-use plastics rules and where they bite on leaf tableware are a separate instrument with a separate test, and they are still transposed nationally, so they remain a country-by-country question even though PPWR is not.
Do I need a PPWR declaration before my first container ships? The EU declaration of conformity has to exist before the packaging is placed on the EU market, which in practice means before customs clearance and release for free circulation, not before the vessel sails. Commission guidance points to Article 39 for the declaration and Annex VII for the technical documentation behind it. Confirm the timing your customs broker expects.
Does PPWR replace my national packaging law in Germany or France? Regulation (EU) 2025/40 replaces Directive 94/62/EC and applies directly, so the product requirements are the same in every Member State. National extended producer responsibility registration and fee schemes still exist and still differ, so you register in Germany, France, the Netherlands or Ireland as before.
Is my existing stock exempt because it landed before 12 August 2026? Not for the PFAS limits. The Commission guidance states plainly that the Regulation does not foresee a transitional period for the exhaustion of stocks, and that food-contact packaging placed on the market after 12 August 2026 must comply. Take your own legal advice on goods already sold through.
My supplier is in India. Can they sign the EU declaration of conformity? The declaration is drafted by the manufacturer, or by an authorised representative appointed by written mandate under Article 17. A manufacturer outside the EU can draft it, but the EU-established importer remains the operator placing the goods on the market and answers to the authority. Settle the mandate in the supply agreement.
Does the harmonised label mean I have to change my artwork now? No. Article 12 labelling applies from 12 August 2028, or 24 months after the relevant implementing acts enter into force, whichever is later. Plan artwork changes for the 2028 window rather than reprinting cartons in 2026.
Are areca leaf plates banned by any part of PPWR? No format restriction in Annex V names plant fibre tableware. Annex V point 3 restricts single-use plastic packaging for food and drink filled and consumed within HORECA premises, and that restriction applies from 1 January 2030.
Who pays if the goods fail a PFAS check at the border? Commercially, whoever the contract says. Legally, the operator who placed the packaging on the market carries the enforcement exposure. Write the test evidence, the test frequency and the remedy into the supply agreement before the first order.
Lane, documentation and destination rules for the markets this article applies to. Each page carries the route, the paperwork set and the quotation route for that destination.
Each link below answers the question this article raises next, whether that is the rule behind a decision, the same question in another destination, or the commercial step that follows.
Send an enquiry that names the product, the annual or per-shipment volume and the destination port or country: for example, 30,000 units of the Reinforced Round Traditional Patravali Meal Plate, 12 inch round, delivered Hamburg. Add one line saying whether you or a European distributor will be the economic operator placing the goods on the EU market, because that decides whose name goes on the conformity file. Foliware India LLP will come back with the declaration set, the composition statement and the PFAS evidence path alongside the quotation.
