Does EPR Under the Indian Plastic Waste Rules Reach Leaf Tableware?

9 min readFoliware India LLPReviewed 16 September 2026

The short answer

Extended producer responsibility under the Plastic Waste Management Rules, 2016 applies to plastic packaging in four defined categories, and every one of them requires plastic. An uncoated areca palm leaf plate is neither plastic nor packaging, so it carries no EPR registration, target or return. The plastic film, liners and strapping the plates ship in are a separate question, and they can pull a buyer into the regime.

What the Indian plastic EPR regime actually covers

Extended producer responsibility, meaning the obligation on a producer to fund and evidence the environmentally sound management of a product to the end of its life, sits in Schedule II of the Plastic Waste Management Rules, 2016. Schedule II was inserted by the Plastic Waste Management (Amendment) Rules, 2022, notified as G.S.R. 133(E) on 16 February 2022, and amended most recently by the Plastic Waste Management (Amendment) Rules, 2026, G.S.R. 237(E) of 31 March 2026.

Paragraph 5.1 of Schedule II lists the categories covered:

Category What it covers Requires plastic?
Category I Rigid plastic packaging Yes
Category II Flexible plastic packaging, single or multilayer, plastic sheets and covers made of plastic sheet, carry bags, sachets and pouches Yes
Category III Multilayered plastic packaging, at least one layer of plastic and at least one layer of another material Yes, at least one layer
Category IV Plastic sheet or like used for packaging, and carry bags made of compostable plastics Yes, compostable plastic

Two definitions close the question. Schedule II paragraph 3(g) defines plastic as material which contains as an essential ingredient a high polymer, and lists polyethylene terephthalate, high density polyethylene, vinyl, low density polyethylene, polypropylene, polystyrene resins and the multi-material families. Paragraph 3(h) defines plastic packaging as packaging material made by using plastics for protecting, preserving, storing and transporting products.

An areca palm leaf sheath contains none of those polymers. It is also not packaging: it is a serving article, the product itself.

So is a leaf plate exempt, or simply out of scope?

Out of scope, which is a stronger position than exempt. An exemption is a carve out you claim and may have to defend. Being outside the definition means there is no obligated entity, no registration, no target and no return to file in the first place.

Paragraph 4 of Schedule II lists the obligated entities: the producer of plastic packaging, the importer of imported plastic packaging or of plastic packaging on imported products, brand owners including online marketplaces and retail chains other than micro and small enterprises, and plastic waste processors. A manufacturer of uncoated leaf tableware does not become any of those by making leaf tableware. Neither does a caterer by buying it.

That is a genuine de-risking answer, and it is worth writing into a procurement file in those terms rather than as a certificate. There is no document called an EPR exemption certificate for a leaf plate under these rules. What exists is a material declaration that lets you show why the rules do not apply.

Where the exposure actually sits: the packing, not the plate

This is the part that catches buyers who stop reading after the good news.

Schedule II paragraph 3(m) defines producer as a person engaged in manufacture or import of carry bags, multilayered packaging or plastic sheets or like, and expressly includes industries or individuals using plastic sheets or like, or covers made of plastic sheets or multilayered packaging, for packaging or wrapping the commodity. In other words, using plastic film to wrap a commodity makes you a producer of that packaging.

Run that against a typical pallet of tableware and the exposure appears in four places.

Component Typical material EPR status Who is likely obligated
The plate, bowl or tray Uncoated areca palm leaf Outside the rules Nobody
Inner pack or bundle sleeve Polythene, polypropylene film or shrink Category II plastic packaging Whoever packs the commodity in it
Outer carton Corrugated board Outside the plastic rules Nobody under these rules
Pallet wrap, strapping, tape Stretch film, PP strap, BOPP tape Category II plastic packaging The party applying it
Retail printed pack, if private label Printed film or laminate Category II or III The brand owner whose label it carries

Three practical consequences follow.

Ask what the goods are packed in before you assume you are clear. A leaf plate supplied loose in a plain corrugated carton and a leaf plate supplied in printed polythene sleeves inside the same carton are the same product with two different regulatory positions.

Private label moves the obligation to you. Schedule II paragraph 3(b) defines a brand owner as a person or company who sells any commodity under a registered brand label or trade mark. If you take the product under your own registered brand in a plastic retail pack, you are the brand owner of that pack. The micro and small enterprise carve out in paragraph 4(iii) applies to brand owners, so a buyer registered under the Ministry of Micro, Small and Medium Enterprises criteria may sit outside it, and a larger buyer will not. Settle the pack specification before the first run, as set out in a private label brand owner’s route to a first production run.

Registration is per entity on a central portal. Obligated entities register and file annual returns on the Central Pollution Control Board’s centralised EPR portal for plastic packaging. If you have any plastic packaging in your business, whether it arrived around leaf plates or around anything else, the registration exists at company level, not order level.

How this differs from the European regime you may already be filing

European buyers importing the same product face a structurally different question, and confusing the two produces the wrong answer in both directions.

India, Plastic Waste Management Rules European Union, national packaging EPR
What triggers the obligation The packaging being plastic The packaging being packaging, in most member states, whatever the material
Are paper and board cartons in scope Not under these rules Yes, and they are the largest reported fraction for many importers
Who is the obligated party Producer, importer or brand owner of the plastic packaging The first party placing the packaging on the national market
Where the leaf plate itself sits Outside, as a non plastic product Outside as a product, though the pack around it is in scope

The European position on who carries the obligation is worked through in who registers for EPR when you import from India, and the data your supplier has to give you before you can file anything is set out in the supplier data you need before you can file an EPR return. Do not port a European conclusion into an Indian filing: India has no general packaging EPR covering paper and board.

What remains unclear, and who confirms it

Two points should be stated as open rather than settled.

Composite and coated leaf products. A leaf article that has been laminated, poly coated or bonded with a plastic film is a different object from an uncoated one, and the plastic definition turns on whether the material contains a high polymer as an essential ingredient. If you are buying a coated leaf or coated board product, get a written composition statement and put the classification question to your State Pollution Control Board or Pollution Control Committee. Do not settle it from a supplier’s opinion.

Waste stream classification of the used plate. The Solid Waste Management Rules, 2026, notified on 27 January 2026 and in force from 1 April 2026, require four stream segregation at source. The Central Pollution Control Board’s summary lists paper and wood under dry waste and kitchen waste under wet waste. A food soiled uncoated leaf plate is not squarely in either example. Ask your local body for the classification in writing before you build a composting claim on it. The wider effect of both 2026 instruments on a foodservice buyer is set out in what the Plastic Waste Management (Amendment) Rules 2026 changed.

Neither of these is a reason to avoid the material. Both are reasons to get the confirmation from the authority rather than from a supplier, including this one.

A four line note for your compliance file

Anyone auditing the decision later will want the reasoning, not a marketing claim. Four lines cover it.

  1. The article is made from areca palm leaf sheath, an uncoated single material, with no polymer content. Evidenced by the supplier’s written material declaration.
  2. Plastic is defined in the Plastic Waste Management Rules, 2016 by high polymer content. The article does not meet it.
  3. EPR under Schedule II covers four categories of plastic packaging. The article is neither plastic nor packaging.
  4. Plastic packaging used in the consignment is listed separately by component and weight, with the obligated entity for each named.

Line four is the one most files are missing, and it is the one a State Pollution Control Board inspection will ask about.

Frequently asked questions

Does a manufacturer of areca leaf plates need EPR registration in India? Not for the plates. Extended producer responsibility under Schedule II of the Plastic Waste Management Rules, 2016 covers producers, importers and brand owners of plastic packaging. An uncoated leaf plate is neither plastic nor packaging. A manufacturer who wraps goods in plastic film is a producer of that film and registers on that basis.

Is there an EPR exemption certificate for leaf tableware? No such document exists under these rules, because the product is outside the definitions rather than exempted from them. What you should hold is a written material declaration from the manufacturer stating the composition, which is what lets you demonstrate the rules do not apply.

Do I have an obligation if I buy leaf plates wrapped in plastic film? Possibly. Schedule II defines producer to include industries or individuals using plastic sheets or covers made of plastic sheets for packaging or wrapping a commodity. Who carries it depends on who first packs the commodity in that film and whose registered brand appears on it. Get the packing composition in writing and take a view with your compliance adviser.

Does India have EPR on paper and board packaging? Not under the Plastic Waste Management Rules, 2016, which are limited to plastic packaging. That is a real difference from several European national schemes, where corrugated cartons are reportable. Confirm the current position for your own business with the Central Pollution Control Board rather than assuming it from a European filing.

Are micro and small enterprises exempt from EPR? Paragraph 4(iii) of Schedule II excludes brand owners that are micro and small enterprises under the Ministry of Micro, Small and Medium Enterprises criteria. The carve out is written for brand owners. Producers and importers of plastic packaging are listed separately and are not given the same exclusion, so check which category you fall into before relying on it.

Where do the EPR filings actually happen? On the Central Pollution Control Board’s centralised EPR portal for plastic packaging, where obligated entities register and file annual returns. Registration is at entity level rather than per consignment, so one registration covers all of your plastic packaging, whatever product it arrived around.
