German packaging extended producer responsibility is not one obligation but four separate acts with three different counterparties. You register in the LUCID Packaging Register, which is free and which you must do yourself. You sign a system participation agreement with a commercial dual system, which costs money. You then report the identical packaging volumes to both. Above set tonnage thresholds you file an audited declaration of completeness by 15 May.
Most European packaging schemes have one counterparty. You join a producer responsibility organisation, it registers you, it invoices you, and the obligation is discharged. Germany does not work that way, and the reason a first German order stalls is usually that a buyer assumed it did.
Germany separates the register from the money. The Zentrale Stelle Verpackungsregister, the German packaging register and the authority supervising packaging law, operates the LUCID Packaging Register. LUCID records who you are, what brands you place on the market and which packaging types you handle. The ZSVR takes no fee for this and provides no waste collection. Collection and recycling are financed through a separate contract with one of the commercial dual systems approved to run the German collection infrastructure. The ZSVR then cross checks what the system operators report against what producers reported to LUCID, and a mismatch is what triggers enforcement. Registration is free. Licensing is not. One of the two cannot be outsourced.
Since 12 August 2026, German packaging law follows the producer definition in Regulation (EU) 2025/40, the Packaging and Packaging Waste Regulation, implemented in Germany by the Verpackungsrecht-Durchführungsgesetz. The parent statute, the Gesetz zur Anpassung des Verpackungsrechts und anderer Rechtsbereiche an die Verordnung (EU) 2025/40, appeared in Bundesgesetzblatt Teil I on 17 July 2026 and replaced the old Verpackungsgesetz.
The ZSVR applies what it calls domestic precedence: the producer is the first company in the German supply chain to make a unit of packaging available in Germany. For a container of areca leaf tableware shipped from Bengaluru to a German importer, that is the German importer. Foliware India LLP is an economic operator in the chain and may be the manufacturer of the packaging it fills, but it is not the German producer, because it does not initiate the German supply chain.
Note what counts as packaging. The Reinforced Round Traditional Patravali Meal Plate is the product. The export carton, the inner liner, the stretch wrap, the pallet and any shelf ready outer are the packaging, and those are what you register and license. Where the obligation lands under each buying structure is set out in the guide to who registers for EPR when you import from India.
Registration is a four part form and it must be completed by the producer itself. The ZSVR is explicit that a service provider or authorised representative may take on nearly every other German packaging obligation, but the initial LUCID registration and any later change to the registration details stay with the producing company.
The four parts are master data, packaging types, brand names and declarations. Master data covers address, contact details, VAT number and tax reference. Packaging types asks you to separate packaging subject to system participation from packaging exempt from it. Brand names must list every brand visible on the packaging you place on the German market, or your company name where no brand appears. The declarations section is where you confirm you are meeting the system participation requirement.
The brand name field causes most of the trouble on a first registration. It has to match what is printed on the carton, so if you are buying private label and the carton carries your own brand, that brand goes in LUCID, not the manufacturer’s. The register also carries an ongoing duty to keep information current, so a brand added mid year is an amendment, not something to tidy up at year end.
Packaging that typically ends up with a private final consumer is systembeteiligungspflichtig, subject to system participation. You choose a system operator from the list the ZSVR publishes and conclude an agreement with it. The fee depends on material and mass, so this is the point at which you need per component weights rather than a shipment total. Getting those weights out of a supplier before the contract is the subject of the note on the supplier data you need before you can file an EPR return.
Whether an outer carton of tableware delivered to a restaurant is system participation packaging depends on where the waste actually arises, and the ZSVR maintains a catalogue indicating how it classifies specific packaging. Ask your system operator to confirm the classification in writing before the first licence.
This is the German step that has no equivalent in the Dutch or French systems. Every data report you make to your system operator must also be filed in LUCID, with the same reporting period, the same system name and the same material types and masses. The ZSVR asks for volumes in kilogrammes to three decimal places.
The table below sets out the report types and when each one can be filed.
| Report | What it covers | Timing |
|---|---|---|
| Initial planned volume report | Your forecast volumes for the following calendar year | Can only be filed up to 31 December of the current year |
| Intra-year volume report | A correction to the current year’s planned volumes, after adjusting them with your system operator | Any time during the current year |
| Year-end volume report | Actual volumes placed on the German market in the past calendar year | Can only be filed up to 1 June; after that it becomes a supplementary report |
| Simplified year-end report | Available to producers who placed under 10 tonnes of system participation packaging on the German market in the previous calendar year, bundling all volume information in one filing | By 1 June of the following year |
That 10 tonne concession matters for a buyer running a single tableware line: below it, you file once a year to LUCID instead of mirroring every report to your system operator. Confirm eligibility with the ZSVR before relying on it, because the threshold is measured on packaging subject to system participation, not on everything you import.
Above any one of three material thresholds in the previous year, you must file a declaration of completeness in LUCID by 15 May. It is a statement of the packaging volumes you placed on the German market, and it has to be audited.
| Material | Threshold in the previous calendar year |
|---|---|
| Glass | 80,000 kg |
| Paper, paperboard and cardboard | 50,000 kg |
| Lightweight packaging: plastics, metals, beverage cartons and other composites combined | 30,000 kg |
The audit must be done by a registered expert, auditor, tax adviser or sworn accountant registered with the LUCID Packaging Register and following the ZSVR audit guidelines. Producer declaration, audit confirmation and audit report are all submitted electronically with qualified electronic signatures. The 15 May deadline moves to the next working day if it falls on a weekend or public holiday and is otherwise not extendable.
For a buyer importing corrugated cartons at volume, the 50,000 kg paper and board threshold is the one to watch. Fifty tonnes of corrugated is a mid sized distributor’s problem, not only a large importer’s, and the audit has to be scheduled months before 15 May rather than booked in April.
Registration, system participation and data reporting all survived the move from the Verpackungsgesetz to the PPWR and the VerpackDG. What changed is the rules deciding who has to do them, because the PPWR producer test replaced the old German one.
Foreign companies that sell empty packaging or packaged products directly to end users in Germany without a German branch must now appoint an authorised representative, which was previously voluntary. The representative concludes system participation agreements, files volume reports, submits declarations of completeness and handles deposit obligations. It must have a German registered office or branch, cannot be an employee of an affiliated company, and the appointment must be a written agreement in German signed by hand or with a qualified electronic signature, recorded in LUCID before products are made available. The producing company still does its own LUCID registration.
Producers operating packaging outside system participation will need ZSVR authorisation, with a transition running to 31 December 2027 for producers and 31 October 2027 for other producer responsibility organisations. Fees and the electronic procedure were still being developed when this article was reviewed, so confirm the current position with the ZSVR rather than budgeting from a figure found elsewhere.
The dependencies run one way, and only the first two are free.
A buyer who starts at step four discovers that the system operator wants weights the supplier has not measured, and a two week data request turns into a missed sailing. Put the weight request in the RFQ, alongside the rest of the documents a European buyer adds to a standard vendor pack.
Foliware can supply what steps three onward need: materials, component weights, carton and pallet configuration. Foliware cannot register in LUCID for you, is not the German producer where your entity first places the goods on the German market, and would not be a valid authorised representative, which has to be an independent party with a German registered office. If your German volumes are small, buying from a German importer who is already the producer is a legitimate route and cheaper in overhead, even though the unit cost is higher. That trade off is set out in Indian manufacturer or European importer.
Can my supplier or a compliance agency register in LUCID for me? No. The ZSVR requires the producing company to complete its own initial LUCID registration and any later changes to the registration details. An authorised representative or service provider can take on system participation, volume reporting and the declaration of completeness, but not the registration itself.
Does LUCID registration cost anything? Registration in the LUCID Packaging Register is free of charge. The cost sits in the system participation agreement with a dual system, which is priced on material and mass, and in the audit if you cross a declaration of completeness threshold.
Do I need a German entity to be the producer? You need to be the first company making the packaging available in the German supply chain, which a German established importer or distributor usually is. A company selling from abroad directly to German end users without a German branch must appoint an authorised representative with a German registered office, who then carries the German obligations apart from the registration.
My cartons are plain brown with no printing. What goes in the brand name field? Your company name. The ZSVR asks for brand names visible on the packaging, and where none appears the registering company’s name is what you enter. Update the registration if you later add a printed private label carton.
When is the first data report due after I sign a dual system contract? You file a data report in LUCID when you conclude the agreement, reporting the same volumes you gave the system operator. After that the rhythm follows the agreement, commonly monthly, quarterly or annually. If no interval was agreed, you report the contracted total as an annual planned volume.
Lane, documentation and destination rules for the markets this article applies to. Each page carries the route, the paperwork set and the quotation route for that destination.
Each link below answers the question this article raises next, whether that is the rule behind a decision, the same question in another destination, or the commercial step that follows.
Send an enquiry naming the product, the annual volume and the German delivery point: for example, the Reinforced Round Traditional Patravali Meal Plate, 40,000 pieces for Hamburg. Tell us whether your entity already holds a LUCID registration number, because that changes whether we send packaging weights for a licence application now or for a first registration. Carton and pallet weights by component and material come back with the quotation. See export capability for the German market or send the RFQ .
